Changes to Australia’s Intellectual Property laws commence on 15 April 2013

Major reforms which affect all of Australia’s current Intellectual Property (IP) laws
come into effect on 15 April 2013.
The Intellectual Property Laws Amendment (Raising the Bar) Act addresses 6 key areas of reforms including:
- Raising the quality of granted patents
- Free access to patented inventions for regulatory approval
- Reducing delays in resolution of trademarks and patent applications and disputes
- Assisting the operation of professionals and the IP profession
- Improving mechanisms for enforcement in trade marks and copyright
- Simplifying the IP system
As Austrade states "Among the changes are stronger patents, clearer guidelines for
researchers, a simpler IP system, and better enforcement against counterfeiters.
Stronger patents
The new laws raise the standard required for an invention to be granted a patent.
Australia’s higher standards will now be in line with our major trading partners such
as the US, Japan and Europe, which will assist exporters in getting the international
protection they need where they need it."
