Higher Education Support Amendment (Maximum Payment Amounts and Other Measures) Act 2012

The Higher Education Support Act 2003 will soon have updated indexed amounts for Other Grants and Commonwealth Scholarships thanks to the Higher Education Support Amendment (Maximum Payment Amounts and Other Measures) Act 2012, assented on the 17 November 2012.

The amending act will allow the Minister for Education to determine the maximum payment amounts for Other Grants and Commonwealth scholarships by legislative instrument from 2013 onwards. It also amends the Australian Research Council Act 2001 to apply indexation against appropriations for existing schemes and add a figure for the last year of the forward budget estimates.

The Act aims to continue to advance Australian’s right to education in accordance with Article 13 of the International Convention on Economic, Social and Cultural Rights. To the extent that it may infringe on human rights in the form of requiring wider disclosure by the Department of student and staff data of higher education providers, it is necessary for research relating to the provision of higher education and training including quality assurance.
