The Full Federal Court has handed down its decision in De Bortoli Wines Pty Ltd v HIH Insurance Ltd (in liq).
The court dismissed the appeal of the appellant who claimed to have suffered loss following multiple purchases of shares in reliance on misleading and deceptive conduct in breach of s 52 of the Trade Practices Act 1974 (Cth). The court found that the primary judge did not err, finding did indeed rely on their own judgment and experience in making each purchase.
