NBN Bills latest amendments to key Bills implications for existing carriers

Recently two key NBN Bills were debated in Parliament; namely, the National Broadband Network Companies Bill 2010 and the Telecommunications Legislation Amendment (National Broadband Network Measures – Access Arrangements) Bill 2011.

Both Bills were subject to last minute amendments relating to the retail carrier and service provider market.

An article just posted to Mondaq by Middletons sets out observations on these amendments with respect to five key issues:

  • wholesale only requirement

  • prohibition on price discrimination

  • cherry picking provisions

  • POI requirement and

  • NBN Co's right to insist on offering bundled services.
