iiNet wins Appeal

The Full Court of the Federal Court of Australia has this afternoon handed down its decision in Roadshow Films Pty Ltd & Ors v iiNet Limited [2011] FCAFC 23.
In short, a majority of the Full Court (Jagot J dissenting) has affirmed the decision of the trial judge and found in favour of iiNet Limited (iiNet).
Once again, the key issue was whether, by failing to take steps to stop the infringing conduct, iiNet "authorised" the copyright infringement of its customers who used a BitTorrent system to unlawfully download copyright films and television programs. The Full Court has confirmed that iiNet did not "authorise" the infringements.
