The introduction of the new Australian Consumer Law provides a chance to review protections for Directors and Officers of businesses in relation to existing and new laws.
The new laws now already in place for almost a month came into effect on 1 January 2011 and an article just posted to Mondaq by Clayton Utz takes a look at the current position of directors and officers and then looks at the effect of the new Competition and Consumer Laws. For those involved in running a business it provides useful information on how the new laws can be contravened and what Directors and Officers can be held liable for, it looks at D&O insurance and the new prohibition on indemnifying directors and officers.
