Income Tax Point-in-Time Service Updates

The Income Tax Point-in-Time Service has been updated to include the Administrative Review Tribunal Legislation Consequential Amendments (2024 Measures No. 1) Regulations 2024 (Cth) and the Taxation Administration Amendment (Extending Tax Whistleblower Protections) Regulations 2024 (Cth).

Administrative Review Tribunal Legislation Consequential Amendments (2024 Measures No. 1) Regulations 2024

These regulations make minor consequential amendments to regulations across the Commonwealth statute book to align with the Administrative Review Tribunal Act 2024 (the ART Act). The ART Act establishes the Administrative Review Tribunal (ART) as a fit-for-purpose federal administrative review body which will replace the Administrative Appeals Tribunal (AAT). These regulations:

  • update terminology, such as repealing outdated references to the Administrative Appeals Tribunal, the AAT and the Administrative Appeals Tribunal Act 1975 (the AAT Act) and replacing them with references to the Administrative Review Tribunal, the ART and the ART Act; and
  • update and replace references to provisions of the AAT Act with references to the equivalent, or broadly equivalent provisions under the ART Act. This includes updating provisions with legislative references in respect of notification requirements, jurisdiction provisions, timeframe, fees, among others.

Taxation Administration Amendment (Extending Tax Whistleblower Protections) Regulations 2024

The purpose of the Regulations is to allow the regulators of the tax system, including the Commissioner of Taxation, Tax Practitioners Board (TPB), the Commissioner of the Australian Charities and Not for profits Commission (ACNC) and Inspector-General of Taxation (IGT) to share whistleblower information for more effective regulatory responses to suspected breaches of the law.

The Regulations support changes made by the Treasury Laws Amendment (Tax Accountability and Fairness) Act 2024 (Cth) to improve the manners in which the TPB can receive disclosures under the Taxation Administration Act 1953 (Cth).

These amendments have been updated in the Point-in-Time Income Tax Service current to 18 October 2024 (NB: subscription required).
