Employment Point-in-Time Service Updates

The Employment Point-in-Time Service has been updated to include the Fair Work Legislation Amendment (Closing Loopholes) Regulations 2024 (Cth), the Fair Work Amendment (Contractor High Income Threshold) Regulations 2024 (Cth) and the Fair Work (Registered Organisations) Amendment (Administration) Act 2024 (Cth) (Act No 74 of 2024).

Fair Work Legislation Amendment (Closing Loopholes) Regulations 2024

These regulations make substantive amendments to the Fair Work Regulations 2009 (Cth) (the FW Regulations), including amendments to:

  • set out a non-exhaustive list of the types of conduct constituting serious misconduct in relation to regulated workers;
  • exempt the livestock industry, including transporting or otherwise dealing with livestock, from the road transport jurisdictions;
  • prescribe a schedule of costs for unfair deactivation and unfair termination matters;
  • prescribe the Fair Work Commission application fee for unfair deactivation, unfair termination and unfair contract term applications;
  • deal with interactions with State and Territory laws for the new regulated workers and road transport contractual chains jurisdictions;
  • specify other proceedings that cannot be progressed at the same time as an unfair deactivation or unfair termination proceeding; and
  • specify provisions under the Competition and Consumer Act 2010 (Cth) that are considered other review proceedings for the purposes of the unfair contract term jurisdiction. 

Fair Work Amendment (Contractor High Income Threshold) Regulations 2024

These regulations amend and insert new provisions into the FW Regulations to prescribe the amount of the contractor high income threshold for the current year and set out the manner in which the contractor high income threshold is to be worked out for a later year.

Act 74 of 2024

The Act amends the Fair Work (Registered Organisations) Act 2009 (Cth) to put the Construction and General Division (and its branches) of the Construction, Forestry and Maritime Employees Union (CFMEU) under administration. This Act also makes amendments to the Fair Work Act 2009 (Cth), including amendments relating to restrictions on removed persons being bargaining representatives.
